  • COMPANY & OPERATOR
    OXeSIM (“OXeSIM”, “we”, “us”, “our”) is a digital platform operated by Ghostonix Global Holdings LLC (“Operator”).
    OXeSIM is not a telecommunications carrier. OXeSIM acts as a reseller and distribution platform for third-party eSIM services.
    By accessing or using the OXeSIM website, services, APIs, or purchasing any product, you (“User”, “Customer”, “you”) agree to be legally bound by these Terms.
  • ELIGIBILITY & ACCEPTANCE
    You must be at least 18 years old to use the Services.
    If you use the Services on behalf of a business or another person, you represent you have authority to bind them to these Terms.
    If you do not agree, do not use the Services.
  • SERVICES DESCRIPTION
    OXeSIM provides access to digital eSIM data plans supplied by third-party network operators, aggregators, and upstream providers.
    OXeSIM does not own, operate, manage, or control mobile networks, radio spectrum, or telecommunications infrastructure.
    All connectivity, coverage, speed, latency, availability, and quality are provided solely by third-party network providers.
  • NO TELECOM STATUS
    OXeSIM is not a telecom carrier, MVNO, ISP, or network operator.
    Any telecom licensing, regulatory authorizations, network permissions, or telecom compliance obligations related to network service are the responsibility of the underlying network providers and/or applicable third parties.
    OXeSIM does not guarantee network performance, coverage, uptime, or uninterrupted service.
  • ACCOUNT, ACCURACY, AND SECURITY
    You agree to provide accurate, complete, and lawful information and keep it updated.
    You are responsible for all activity conducted through your account, device, email, and purchase credentials.
    You must promptly notify us of unauthorized access or security issues.
    We may suspend or restrict access for suspected fraud, abuse, or security risk.
  • USER RESPONSIBILITIES
    You are responsible for device compatibility (eSIM-capable and unlocked device).
    You are responsible for proper installation, activation, and device configuration.
    You will comply with all applicable local, national, and international laws and regulations.
    You will not use the Services for unlawful, abusive, fraudulent, or prohibited activities.
    You will comply with our Acceptable Use Policy (AUP) and all other posted policies.
  • THIRD-PARTY SERVICES & FLOW-THROUGH TERMS
    eSIM services sold via OXeSIM are subject to third-party terms, including acceptable use, fair usage, network limitations, and local restrictions.
    OXeSIM’s obligations are strictly limited to resale and access facilitation.
    Network providers may suspend, throttle, restrict, modify, or terminate service at any time (including for compliance, fraud prevention, fair use, or local requirements).
    Coverage maps, speeds, and data limits are estimates and are not guarantees.
    Third-party providers may change, discontinue, or limit plans/features at any time; OXeSIM is not liable for third-party changes outside our control.
    You agree not to resell, sublicense, redistribute, “SIM farm,” or provide the Services for further resale unless we explicitly authorize it in writing.
  • DIGITAL DELIVERY; NO RIGHT TO CANCEL AFTER DELIVERY
    eSIMs and related digital items are digital goods/services and may be delivered instantly.
    Once an eSIM is issued, assigned, delivered, displayed (including QR code), installed, activated, or used (in whole or in part), it may become non-refundable and non-cancellable as described in our Refund Policy (and to the maximum extent permitted by law).
  • PRICING, PAYMENTS & TAXES
    All prices are shown at checkout.
    OXeSIM may change prices at any time without notice.
    You are responsible for all applicable taxes, duties, VAT, or fees.
    You are responsible for selecting the correct plan before checkout.
    You authorize us (and our payment providers) to charge your selected payment method for purchases, fees, and applicable taxes.
    We may refuse, cancel, or limit transactions where required by law, compliance, fraud prevention, security, or risk management.
    All sales are final, except where required by law or explicitly stated in our Refund Policy.
  • REFUNDS & CHARGEBACKS
    Refunds are governed strictly by the Refund Policy.
    Improper chargebacks or payment disputes constitute a breach of these Terms.
    We may suspend or terminate accounts involved in disputes, fraud, or abuse.
    We may contest chargebacks using transaction, delivery, and usage records.
    You may be responsible for chargeback fees, administrative costs, and collection costs to the maximum extent permitted by law.
    OXeSIM is not responsible for network-related dissatisfaction once an eSIM is delivered or activated.
    Refunds are governed strictly by the Refund Policy. The Refund Policy is incorporated into these Terms by reference and is available here: Refund Policy.
  • DATA, PRIVACY & eKYC
    OXeSIM processes customer data in accordance with its Privacy Policy.
    Certain jurisdictions or network providers may require identity verification (eKYC) or other compliance steps.
    Customer data may be securely shared with third-party providers solely to deliver the service, prevent fraud, comply with lawful requirements, or support technical operations.
    OXeSIM does not control how telecom operators and upstream providers process data beyond contractual safeguards and legal requirements.
    If you refuse or fail required verification, service may be restricted or denied; refunds (if any) are governed strictly by the Refund Policy and applicable law.
  • DISCLAIMERS OF WARRANTIES
    To the maximum extent permitted by law, all Services are provided “AS IS” and “AS AVAILABLE”.
    OXeSIM disclaims all warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement.
    OXeSIM does not warrant network availability or performance, error-free operation, uninterrupted service, or that the Services will meet your requirements.
  • LIMITATION OF LIABILITY
    To the maximum extent permitted by law, OXeSIM and Ghostonix Global Holdings LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, revenue, goodwill, or business.
    OXeSIM is not liable for network failures, outages, throttling, coverage limitations, local restrictions, third-party provider actions, device incompatibility, user error, or force majeure.
    Total aggregate liability (if any) shall not exceed the lesser of:
    USD $1,000
    The total amount paid by the customer in the preceding 12 months
  • INDEMNIFICATION
    You agree to defend, indemnify, and hold harmless OXeSIM and Ghostonix Global Holdings LLC (including their owners, officers, directors, employees, contractors, and affiliates) from any claims, damages, losses, fines, penalties, fees, and legal costs arising from or related to:
    Your misuse of the Services
    Violations of law or regulation
    Chargebacks, disputes, complaints, or refund demands
    Regulatory actions triggered by your conduct
    Your breach of these Terms, the Refund Policy, the Privacy Policy, or the AUP
  • TERMINATION & ENFORCEMENT
    OXeSIM may suspend, restrict, or terminate access at any time, with or without notice, for:
    Breach of these Terms
    Fraud, abuse, misuse, or suspected wrongdoing
    Legal, regulatory, compliance, or risk requirements
    Termination does not relieve you of obligations accrued prior to termination.
    No refunds will be issued for enforcement actions except where required by law.
  • FORCE MAJEURE
    OXeSIM shall not be liable for failure or delay caused by events beyond reasonable control, including network outages, government actions, war, sanctions, embargoes, natural disasters, infrastructure failures, supplier failures, or Internet/telecom disruptions.
  • DISPUTE RULES (NO CLASS / NO JURY)
    You waive any right to a jury trial.
    All claims must be brought individually, not as part of any class, collective, or representative action.
  • TIME LIMIT TO BRING CLAIMS
    To the maximum extent permitted by law, any claim must be filed within 12 months of the event giving rise to the claim, or it is permanently barred.
  • GOVERNING LAW & JURISDICTION
    These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles.
    Exclusive jurisdiction and venue shall lie in the state or federal courts located in NM, USA unless a mandatory consumer protection law requires otherwise.
  • SEVERABILITY
    If any provision is held unenforceable, the remaining provisions remain fully effective.
  • AMENDMENTS & MODIFICATIONS
    OXeSIM reserves the absolute right, at its sole discretion, to modify, update, amend, add to, or remove these Terms at any time, without prior notice.
    Changes are effective immediately upon posting.
    Continued use constitutes binding acceptance.
    Your sole remedy if you disagree is to discontinue use of the Services.
  • UNLIMITED PLANS & FAIR USAGE POLICY (FUP)
    Some “Unlimited” plans are subject to Fair Usage Policy limits. After a certain amount of high-speed data within a specific period, network speeds may be reduced for the remainder of that period.
    FUP thresholds and speed behavior vary by country, network, and plan details.
  • ADDITIONAL LEGAL PROTECTIONS (E-SIGN, ASSIGNMENT, NO RELIANCE, LANGUAGE, SURVIVAL, SUPPORT, NOTICE, FEES)

    – Electronic Communications & E-Signature Consent
    You consent to receive all notices, disclosures, invoices, updates, and communications electronically (including by email, website notice, or account message).
    Your use of the Services, submitting forms, creating an account, or completing checkout constitutes your electronic signature and legally binding acceptance.

    – Assignment
    OXeSIM may assign or transfer these Terms and any related agreements, rights, or obligations to any affiliate, successor, or buyer at any time.
    You may not assign, transfer, or delegate any rights or obligations without OXeSIM’s prior written consent.

    – No Reliance / No Advice
    Any information on the Services or provided by support is general information only and is not legal, telecom, regulatory, financial, or travel advice.
    You agree you are not relying on any statement, estimate, or representation as a guarantee, and that you are solely responsible for your decisions, device compatibility, and use.

    – Language Control
    If any translation of these Terms or policies is provided, the English version controls in the event of any conflict or inconsistency.

    – Survival
    All sections intended to protect OXeSIM survive termination, including refunds/chargebacks, acceptable use/enforcement, disclaimers, limitation of liability, indemnification, dispute rules, attorney’s fees, and the entire agreement clause.

    – Support Response Disclaimer
    Support response times are not guaranteed. Delays, non-response, or support outcomes do not create any refund rights, credits, or liability.

    – Notices / Deemed Received
    Notices are deemed delivered and received when sent to the email address you provided, posted on the website, or delivered via account message, regardless of whether you actually read them.
    You are responsible for keeping your contact information accurate and monitoring communications.

    – Attorney’s Fees & Costs
    To the maximum extent permitted by law, if OXeSIM prevails in any dispute, claim, or proceeding arising out of or related to the Services, you agree to pay OXeSIM’s reasonable attorneys’ fees, costs, and expenses.

  • ENTIRE AGREEMENT
    These Terms, together with the Privacy Policy, Refund Policy, Acceptable Use Policy (AUP), and all other policies in our Legal Center, constitute the entire agreement between you and OXeSIM.

    – Information collected automatically

    – Approximate location derived from IP (not precise GPS unless you explicitly enable it on your device)

  • DATA SHARING & DISCLOSURE
    We may share information only as necessary, and only for legitimate operational, security, compliance, or service-delivery purposes, including with:
    – Connectivity and infrastructure providers (to provision and deliver eSIM services)
    – Payment processors and fraud-prevention partners (to process payments and prevent misuse)
    – Hosting, security, analytics, and performance providers (to run and protect the platform)
    – Professional advisors (legal, accounting, compliance) as needed
    – Authorities, regulators, or lawful requestors when legally required or to protect rights, safety, and security
    Critical notices:
    – Once data is lawfully shared with third parties, those parties may act as independent controllers for their own purposes.
    – OXeSIM does not control and is not responsible for third-party processing practices outside our direct control.
    – You agree that third-party acts or omissions do not create liability for OXeSIM to the maximum extent permitted by law.
  • TELECOM & CONNECTIVITY DISCLAIMER
    – Connectivity services are provided by independent third parties.
    – OXeSIM does not guarantee network availability, speed, coverage, latency, quality, uptime, or uninterrupted service.
    – Outages, throttling, congestion, geographic limitations, roaming restrictions, local regulations, or provider actions may impact service.
    – Use of connectivity services is at your own risk.
  • IDENTITY VERIFICATION (IF REQUIRED)
    – Certain destinations, providers, payment processors, or compliance rules may require identity verification or additional information.
    – If required and you fail, refuse, or cannot complete verification, service may be restricted or denied.
    – Any refunds (if applicable) are governed strictly by our Refund Policy and applicable law.
  • COOKIES & TRACKING
    – We use cookies and similar technologies for authentication, security, fraud prevention, performance, and analytics.
    – Disabling cookies may limit or break functionality.

    – No system is perfectly secure. We do not guarantee absolute security.
    – You acknowledge and accept the inherent risk of Internet-based systems, and you agree OXeSIM is not liable for unauthorized access, hacking, interception, or breaches outside our reasonable control to the maximum extent permitted by law.
  • DATA RETENTION
    – We retain data only as long as necessary for:
    – Providing the Services
    – Legal, regulatory, tax, and accounting obligations
    – Fraud prevention, security, and dispute/chargeback handling
    – Enforcing our policies and protecting our rights
    – We may anonymize or aggregate data and retain it indefinitely.
  • USER RIGHTS (LIMITED)
    – Depending on your location, you may request access, correction, or deletion of certain data.
    – These rights are not absolute and may be denied or limited where data is required for:
    – Legal compliance
    – Security or fraud prevention
    – Dispute resolution or chargeback defense
    – Completion or continuation of Services
    – We may require identity verification before acting on requests.
    – Requests can be denied where permitted by law, including where requests are abusive, repetitive, impractical, or compromise security.
  • THIRD-PARTY LINKS & SERVICES
    – The Services may include third-party links, tools, or integrations.
    – We are not responsible for third-party privacy, security, availability, or practices.
  • AGE RESTRICTION
    – The Services are intended for users 18 years or older.
    – We do not knowingly collect personal data from minors.
  • LIMITATION OF LIABILITY (MAXIMUM SHIELD)
    To the maximum extent permitted by law:

Refund & Cancellation Policy

REFUND & CANCELLATION POLICY

This Refund & Cancellation Policy (“Policy”) governs all purchases made through OXeSIM (“OXeSIM”, “we”, “us”, “our”).
By purchasing, accessing, or using any OXeSIM product or service, you acknowledge and agree to this Policy. If you do not agree, do not complete a purchase.

 

  • CRITICAL NOTICE (DIGITAL GOODS)
    OXeSIM sells digital eSIM products and digital services that are:
    instantly deliverable
    consumable upon issuance, assignment, display (QR / install link), installation, activation, or use
    dependent on third-party connectivity, infrastructure, and regulatory environments
    Because of this, cancellations and refunds are strictly restricted.
  • ALL SALES FINAL (NO CASH REFUNDS)
    ALL SALES ARE FINAL to the maximum extent permitted by law.
    NO cash refunds are provided.
    NO refunds to the original payment method are provided.
    Once an eSIM is issued, assigned, delivered, displayed, installed, activated, or used (in whole or in part), it is permanently non-refundable and non-cancellable.
    This applies even if usage is zero after delivery.
    If a mandatory consumer protection law requires a monetary refund and does not allow store credit as a substitute, we will comply only to the minimum extent required by law.
  • NO RIGHT OF WITHDRAWAL / COOLING-OFF (WHERE PERMITTED)
    By completing a purchase, you acknowledge and agree that:
    the purchase is digital content and/or a digital service
    performance may begin immediately
    you expressly consent to immediate delivery
    you waive any statutory withdrawal/cooling-off right where permitted once delivery begins
  • THE ONLY REMEDY WE MAY OFFER (OXESIM CREDIT ONLY)
    In the rare event a remedy is granted, it is NOT a cash refund.
    The only remedy we may offer, at our sole discretion, is one of the following:
    OXeSIM account credit
    a coupon code usable only on OXeSIM products/plans
    Credit/coupons:
    have no cash value
    are non-transferable and not resellable
    cannot be redeemed for cash, bank transfer, crypto, or any other payment method
    may be revoked if fraud, abuse, or misuse is suspected
    expire 12 months after issuance (no extensions)
  • ELIGIBILITY FOR CREDIT/COUPON (ONLY IF OXESIM FAULT IS PROVEN)
    A credit/coupon may be considered ONLY if ALL conditions below are met:
    the issue was caused solely by a verified technical failure directly attributable to OXeSIM (not network/provider, not device, not user error)
    the eSIM was never issued, assigned, delivered, displayed, installed, activated, or used
    our internal logs and system records confirm OXeSIM fault and confirm non-delivery/non-issuance
    you submit the request within 7 calendar days of purchase
    you provide complete documentation requested (order number, purchase email, device model/OS, destination, screenshots/logs if requested)
    If any condition is not met, the request is denied with no remedy.
  • NON-ELIGIBLE SCENARIOS (NO REMEDY)
    No credit, coupon, or refund will be issued for any of the following (including but not limited to):
    device does not support eSIM
    device is carrier-locked or restricted
    user error during installation/activation
    deleted eSIM, reset device, wrong APN/settings, misconfiguration
    wrong plan selected (country/region/global), changed travel plans, trip cancellation/delay
    purchase timing issues (too early/too late)
    unused data, partial use, expired plans, “did not use” claims
    coverage gaps, slow speeds, latency, congestion, throttling/FUP behavior
    outages, maintenance, roaming limitations, local restrictions
    identity verification or compliance requirements (including failure/refusal to complete)
    any third-party/network/provider act or omission
    force majeure, government actions, sanctions, embargoes, or legal restrictions
    dissatisfaction based on expectations not guaranteed by OXeSIM
  • THIRD-PARTY CONNECTIVITY DISCLAIMER
    Connectivity is provided by independent third-party networks and infrastructure providers.
    OXeSIM does not control coverage, speed, quality, uptime, routing, throttling, or local restrictions.
    Third-party limitations do not create eligibility for any refund, credit, or coupon.
  • CHARGEBACKS, DISPUTES & ABUSE
    Chargebacks and payment disputes without first contacting OXeSIM are treated as abuse.
    We may suspend/terminate your account and restrict future purchases.
    We may contest disputes using transaction, delivery, and usage logs.
    You may be responsible for dispute/chargeback fees, administrative costs, and collection costs to the maximum extent permitted by law.
  • REQUEST PROCESS (IF YOU CLAIM ELIGIBILITY)

    Include:
    order number
    purchase email
    detailed issue description
    device model + operating system
    destination country/region
    screenshots/logs if requested
    Incomplete submissions may be denied automatically.
  • DECISION AUTHORITY (FINAL)
    All determinations are made solely by OXeSIM.
    Decisions are final and binding.
    No appeal is guaranteed.
  • LIMITATION OF LIABILITY
    To the maximum extent permitted by law:
    OXeSIM is not liable for refund/credit denials, provider failures, network performance issues, device issues, user error, or third-party acts.
    Total aggregate liability related to any purchase/refund/credit issue is limited to the lesser of:
    the amount paid for the affected purchase
    USD $100
  • INDEMNIFICATION
    You agree to defend, indemnify, and hold harmless OXeSIM from any claims, losses, damages, penalties, fines, costs, and legal fees arising from:
    your purchase, use, misuse, or attempted misuse
    disputes/chargebacks/refund attempts
    violation of this Policy or any OXeSIM policy/terms
    disputes with third parties (including providers, regulators, payment partners)
  • POLICY MODIFICATIONS
    We may modify or replace this Policy at any time without prior notice.
    Changes take effect immediately upon posting.
    Continued use constitutes acceptance.
  • GOVERNING TERMS
    This Policy is governed by and incorporated into the General Terms & Conditions (GTC).
    Any disputes follow the dispute rules in the GTC.
    If there is any conflict, the GTC controls.

This Acceptable Use Policy (“AUP”) governs your access to and use of OXeSIM (“OXeSIM”, “we”, “us”, “our”) and all related services, products, and digital eSIM plans (collectively, the “Services”).
By using the Services, you agree to comply with this AUP. If you do not agree, do not use the Services.

 

  • SCOPE & ENFORCEMENT
    This AUP applies to all users, customers, visitors, devices, accounts, transactions, and usage linked to OXeSIM.
    OXeSIM may enforce this AUP at any time, with or without notice, in its sole discretion.

  • PROHIBITED ACTIVITIES (STRICTLY FORBIDDEN)
    – Fraud, deception, or abuse
    chargeback abuse, refund fraud, friendly fraud, or disputing valid purchases

    creating multiple accounts to bypass restrictions, limits, enforcement, or bans
    reselling, sublicensing, redistributing, “SIM farming,” pooling, or commercial exploitation without written authorization
    – Network, telecom, and technical abuse
    any attempt to disrupt, overload, degrade, attack, probe, or reverse engineer networks, systems, APIs, or infrastructure
    scanning, penetration attempts, traffic flooding, DDoS, malware delivery, botnets, phishing, or exploitation
    routing manipulation, tunneling abuse, unauthorized proxies, or activity intended to evade controls
    using the Services to host or distribute malicious code, spyware, adware, ransomware, or harmful content
    – Illegal or regulated conduct

  • FAIR USE & “UNLIMITED” PLANS
    Some plans may be subject to fair usage limits or network management rules.
    Excessive, abnormal, or automated usage patterns may result in throttling, restriction, suspension, or termination by OXeSIM or third-party providers.
    You acknowledge that network providers may apply traffic management, speed reductions, or restrictions without notice.
  • COMPLIANCE & VERIFICATION
    We may request verification or additional information to prevent fraud, comply with law, or protect the platform.
    If you fail or refuse verification, we may restrict, suspend, or deny service without liability.

    Forfeiture of any credits/coupons for abuse, fraud, or chargeback activity
    Reporting to payment processors, fraud networks, regulators, or law enforcement where appropriate

  • NO LIABILITY FOR ENFORCEMENT
