  1. About OXeSIM

OXeSIM™ (“OXeSIM,” “we,” “us,” or “our”) provides global eSIM-based mobile data services through its website, applications, and related platforms (collectively, the “Platform”). OXeSIM operates as a digital distributor and facilitator of connectivity services provided by third-party network operators and infrastructure partners worldwide.

OXeSIM does not own, operate, or control mobile networks. Connectivity performance depends on third-party carriers, local infrastructure, device compatibility, and geographic conditions.

  1. Acceptance of These Terms

By accessing, browsing, purchasing from, or using the Platform or Services, you confirm that you have read, understood, and agree to be legally bound by these General Terms & Conditions (“Terms”), together with any policies referenced herein (collectively, the “Agreement”).

If you do not agree, do not use the Platform or Services.

  1. Scope of These Terms

These Terms apply to:

  • All users of the Platform
  • All purchases and use of OXeSIM eSIM products
  • All support, content, and communications

Additional policies may apply, including:

  • Privacy Policy
  • Refund Policy
  • Acceptable Use Policy

In the event of conflict, these General Terms prevail unless expressly stated otherwise.

  1. Services & Limitations

OXeSIM provides digital eSIM data plans that enable mobile internet access where supported.

You acknowledge and agree:

  • Coverage, speed, latency, and availability are not guaranteed
  • Service quality may vary by location, device, network congestion, or local regulations
  • OXeSIM does not guarantee uninterrupted or error-free service
  • eSIM compatibility depends on your device manufacturer and OS version
  1. No Emergency or Critical Use

OXeSIM Services are not intended for emergency services, mission-critical communications, medical systems, or life-support usage. You assume all risk if used for such purposes.

  1. Third-Party Providers

OXeSIM relies on independent third-party carriers, infrastructure providers, and payment processors. OXeSIM is not responsible for:

  • Acts or omissions of third parties
  • Network outages or failures
  • Carrier policy changes
  • Local regulatory restrictions

Any dispute related to third-party services remains between you and that third party, to the fullest extent permitted by law.

  1. Payments, Pricing & Taxes
  • Prices are displayed at checkout and may change without notice
  • You are responsible for any applicable taxes, duties, or fees
  • Payments are processed by third-party payment providers
  • Failed, reversed, or disputed payments may result in suspension or termination of Services
  1. Refunds

Refunds are governed solely by our Refund Policy.
No refunds are guaranteed unless expressly stated in writing.

  1. Intellectual Property

All content, trademarks, software, designs, logos, and materials on the Platform are the exclusive property of OXeSIM or its licensors.

You may not copy, modify, distribute, reverse-engineer, scrape, or exploit any part of the Platform without prior written consent.

  1. Prohibited Use

You agree not to:

  • Use Services unlawfully or fraudulently
  • Resell or redistribute eSIMs without authorization
  • Abuse networks, systems, or bandwidth
  • Attempt to bypass security or usage limits

Violation may result in immediate termination without refund.

  1. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OXESIM PROVIDES THE PLATFORM AND SERVICES “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • AVAILABILITY OR PERFORMANCE
  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • OXESIM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES
  • THIS INCLUDES LOSS OF PROFITS, DATA, BUSINESS, OR OPPORTUNITY
  • OXESIM’S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED USD $100 OR THE AMOUNT YOU PAID FOR THE SERVICE (WHICHEVER IS LESS)

THIS LIMIT APPLIES REGARDLESS OF THEORY OF LIABILITY.

  1. Indemnification

You agree to defend, indemnify, and hold harmless OXeSIM, its officers, directors, employees, contractors, and partners from any claims, damages, liabilities, losses, or expenses arising from:

  • Your use or misuse of the Services
  • Violation of these Terms
  • Violation of any law or third-party rights
  1. Termination

OXeSIM may suspend or terminate your access at any time, with or without notice, for any reason, including suspected misuse or legal risk.

Termination does not affect accrued rights or limitations of liability.

  1. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of NM, United States, without regard to conflict-of-law principles.

You agree that any dispute shall be brought exclusively in state or federal courts located in NM, and you consent to personal jurisdiction therein.

  1. Class Action Waiver

YOU AGREE THAT ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY.
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

  1. Severability

If any provision is found unenforceable, the remaining provisions remain fully enforceable.

  1. Changes to These Terms

OXeSIM may update these Terms at any time without prior notice. Continued use after publication constitutes acceptance of the updated Terms.
